1. This is an agreement between John and Elaine Stephen trading as Vacation Villas, 109 Queen Street, Peterhead, as agents for the Property Owner and the Holidaymaker who has signed the annexed Booking Form.

2. This Contract concerns the lease of holiday property. Vacation Villas are Agents of the Property Owner. Vacation Villas will disclose to the Holidaymaker the name and designation of the property owner prior to date of departure. 

The Holidaymaker by his or her signature to the annexed Booking Form, acknowledge that his or her Contract for the Lease of the holiday property is with the Property Owner and not with Vacation Villas. The Holidaymaker further warrants that he or she is over 18 years of age.

3. Subject to the Terms of Clause 2 hereof, the Holidaymaker must sign and return to Vacation Villas the annexed Booking Form. An initial payment of 25% of the total property rental price is due and payable at the time of booking, and the Holidaymaker’s payment of this sum must accompany the Booking Form.

4. The balance of payment due must be received at least 8 weeks prior to the date of departure. In the case of bookings made less than 8 weeks before the date of departure, full payment must accompany the Booking Form. If payment is not received by the due date, the right to cancel the booking is reserved, and charges will apply as set out in paragraph 5 below.

5. CANCELLATION BY YOU. If you wish to cancel your booking, written notification must be given by the person who signed the Booking Form. The date of cancellation will be the date the written notice is received. In the event of cancellation by you, the following cancellation charges will be payable by you:

6. If circumstances arise beyond our control, the right is reserved to cancel your booking. In this event, we will attempt to find you alternative comparable accommodation or refund all monies paid.

7. REFUNDABLE DEPOSIT. At the time of full and final payment, a refundable security deposit is also required. This deposit will be refunded net of any excess cleaning costs, replacement of lost keys and repairs for damage to the property or any of its contents. This deposit less any charges, will be refunded within 30 days of end of letting period.

8. No compensation will be paid due to changes or cancellations due to war, threat of riots, natural disaster, fire or adverse weather conditions.

9. If the Holiday property has a private swimming pool, then the Holidaymaker should ensure that no child under the age of 16 years is left unattended and unsupervised by an adult in the vicinity of the pool

10. Vacation Villas will not be liable to the Holidaymaker for any loss or damage, contractual or delictual, arising from the Holidaymaker’s occupancy of the property.

11. The terms of this Agreement are constructed in accordance with the Laws of Scotland and the parties hereby prorogate jurisdiction over any dispute arising herefrom to the non-exclusive jurisdiction of the Scottish Court.

12. You are strongly advised to take out adequate insurance cover before leaving the United Kingdom - medical expenses in the U.S. can be particularly high.
